MASTER BOARDING AGREEMENT
This Agreement and the Supplements referred to herein shall apply to all visits by your Dog to K9 CLUBHOUSE.
1. Services. We agree to provide the specific services (“services”) to your Dog for each visit as indicated on the Dog Service Card that will be filled out for each of your Dog’s visits. We will exercise reasonable judgment in all circumstances as we provide the services.
2. Payment for services. You agree to pay us for the services we provide to your Dog during each visit at the rates set forth in the Rates Brochure at the start of such visit (collectively the “Charges”). Charges begin on the day you leave your Dog. Check out time is by 8:00 p.m. sharp on the Departure Date and additional charges will be due for late check out as provided in the Services and Rates Brochure.
3. Reservations. Reservations will not be accepted or guaranteed without a credit card or deposit.
4. Cancellations. If you need to cancel your reservation, please do so at least (5) days prior to your arrival date to avoid the one night room rate cancellation fee. Cancellations called in on the day of or a “No Show”, you agree to pay the booked reservation in full and the cost will be charged to the credit card K9 CLUBHOUSE has on file for you.
5. Your Agent. If we cannot reach you, you authorize us to contact the individual designated as your Agent. You agree that your Agent shall have your full and complete authority to make all decisions, including the expenditure of funds, for or on behalf of you and your Dog.
6. Emergencies. In the event of an emergency evacuation of the K9 CLUBHOUSE, every effort will be made to contact you or your Agent. You authorize us to make temporary alternative arrangements to house and care for your Dog until such time you or your Agent can retrieve the Dog.
7. Safety. I understand that it is not always possible for K9 CLUBHOUSE to prevent injuries that may occur during off-leash activities. All dog play is carefully monitored by K9 CLUBHOUSE to avoid injury, but scratches, punctures, torn ligaments, etc., may occur despite the best supervision. I understand and agree that K9 CLUBHOUSE, its employees, staff or volunteers, will not be liable for any illness, injury, death, and/or escape of my dog. I acknowledge that K9 CLUBHOUSE, its employees, staff or volunteers will take such actions as are reasonable to minimize these risks. I will be responsible for the actions of my dog if it causes any damage whatsoever, including but not limited to damage or injury to other dogs, people, or objects while in the care of K9 CLUBHOUSE. I further understand and agree that my dog will have access to a fenced outside area and I agree to assume full liability if my dog escapes.
8. Dog Health and Behavior. We are prepared to care for older Dogs and to administer routine medications for chronic conditions, but we are not equipped to care for acutely sick Dogs or aggressive or biting Dogs.
• No Dog can stay with us unless we have proof all of the Dog’s required immunizations are current and the Dog is healthy as set forth in K9 CLUBHOUSE’s requirements.
• If your Dog is found to have fleas or ticks, you authorize their removal at your additional expense.
• We reserve the right to refuse to accept a Dog if at Check-In it appears to us that such Dog is sick or that its behavior could jeopardize the health or safety of other Dogs or our staff.
• If your Dog becomes sick or injured and requires professional attention, or if your Dog passes away during its stay, we will attempt to notify you or your Agent at the telephone numbers you provide by you. If we cannot reach you or your Agent, K9 CLUBHOUSE at its sole discretion, may engage the services of a veterinarian and/or administer medicine or give other requisite attention to your Dog, and the expense thereof shall be paid by you.
9. Dogs not picked up on Departure Date. In the event that you or your Agent do not pick up your Dog on the agreed upon Departure Date, you hereby authorize us to continue to provide the daily services set forth in this Agreement.
• Notwithstanding the foregoing, if such Dog becomes abandoned as defined by local or state regulations, we will follow the Abandoned Dog Procedure.
10. Abandoned Dog Procedure.
• All services for such Dog, other than Basic Services (as defined in our Services and Rates) and any necessary medical treatment, will be terminated.
• We will send a certified letter (return receipt requested) to you at the address that you have provided on the reverse side, the second day following the scheduled Check-out date for your Dog, advising you that if your Dog is not picked up within ten (10) days of the Check-out date your Dog will be deemed to be abandoned, that we must deliver the Dog to Animal Control or, where permitted by law, a third party adoption partner and shall have no further responsibility for the Dog.
• You shall remain liable to us for all unpaid charges including the court costs and reasonable attorney’s fees incurred in the collection of the Charges.
11. Your representations to us. You represent to us that you are the owner of the Dog and that you are fully authorized to enter into this Agreement. All of the information about you and your Dog in this Agreement is true, accurate and complete.
• To the best of your knowledge, your Dog has not been exposed to rabies, distemper or any contagious illness within 30 days prior to beginning its stay with us.
• To the best of your knowledge, your Dog has no illness or behavior problem (including aggressive or biting behavior) that has not been disclosed to us.
• You agree to indemnify and hold us harmless, from and against all loss, damage or expense, including attorney’s fees, resulting from misrepresentations by you or your representatives or resulting from your Dog’s stay including, without limitation, any person claiming to be the owner of your Dog and any person claiming damage or injury by your Dog.
12. Miscellaneous Provisions. This written Agreement constitutes our entire and only agreement and there are no oral agreements or understandings except as provided for herein.
• This Agreement can only be changed in writing signed by you or your Agent and by us.
• This Agreement shall bind us and our assigns and you and your heirs and assigns.
• The law that applies to the Agreement is the law of the state and municipality where your Dog is to stay. If there are disputes that result in litigation, the courts of the state and municipality where your Dog is to stay shall have exclusive jurisdiction.
13. Contact with Other Dogs. While your Dog is staying with us, he or she may come into contact with other Dogs depending on the services you request.
• You acknowledge and agree that in the unlikely event your Dog is injured by another Dog, you will not hold us responsible for the injury.
• If your Dog injures another Dog, you will be solely responsible for any injury.
• Communicable diseases: all dogs coming into the K9 CLUBHOUSE are fully vaccinated. However, it is still possible for a dog to become ill, even if vaccinated. This is not due to any circumstance or condition at the K9 CLUBHOUSE and you agree that you will not hold us liable in the event your Dog becomes ill during or after its stay.
14. Personal items. Do not bring items with your Dog that are valuable or irreplaceable. K9 CLUBHOUSE is not responsible for loss or damage to any personal item or toy left with your Dog.
15. Early Pick ups. Since boarding is our primary business, we reserve the right to charge for ALL nights reserved, even if unused should you pick your dog(s) up early.
16. Web Cams. Web cams are a service that we offer for dogs staying in Suites or Deluxe Suites only. The web cams are an extended service and are not guaranteed. Web cams can be accessed via the internet using a pc and Internet Explorer. Users must have administrative rights to the pc and able to lower the security settings, turn down firewalls and antivirus software. A Help section is located on our website for assistance in setting up the camera software. K9 CLUBHOUSE is not able to trouble shoot your system for connectivity issues.
